Umzimvubu local municipality has been advised that the residents of Papanana location in ward 16 have illegally occupied municipal land, amidst a court order prohibiting land invasion in that area. The Municipality has noted this mischievous act as the second attempt to forcefully demarcate and occupy municipal land unconstitutionally. In 2012 Chief Fana Leonard Makaula and other unlawful occupiers of Papanana were served with a court order after they erected fences and occupied KwaBhaca municipal commonage land, ERF 351 with no ownership documents.

In relation to the above mentioned statement, it is therefore recorded that the unlawful occupiers of Papanana are in full breach of the court order which clearly states that; the chief was interdicted and restrained from demarcating and allocating residential sites on land that is part of ERF 351. The court order further prohibited residents from building and erecting fences on the municipal land. Moreover it also required the unlawful occupiers to remove all structures erected or constructed.

Unfortunately the erected infrastructure and steel equipment used to demarcate municipal land was lawfully removed and demolished by Umzimvubu Local Municipality. The situation is currently close monitored by municipal officials and strategic government stakeholders.

According to the Honourable Mayor, Cllr Bulelwa Mabengu,” Umzimvubu Local Municipality urges all community members to take strong precautious before purchasing “vacant” land on “offer”. The municipality strongly condemns illegal land invasion and will proceed with the necessary legal action against the perpetrators involved.” she concluded.
