Umzimvubu Local Municipality has been advised on illegal RDP occupants in Chitwa Village, EmaXesibeni (previously known as Mount Ayliff). Subsequent to a court order granted in 2015 by the Eastern Cape High Court in Mthatha, the illegal occupants were prudently served with a notice to vacate the homes. However it is unfortunate to note that the respondents have subsequently ignored the notice and have continued to unlawfully occupy these structures.

After a number of civil attempts by the municipality to vacate the illegal occupants, the municipality has been left with no other alternative but to commence effectively with sub-paragraph 15.2 of the court order which reads:

“In the event of the respondents failing to vacate and handover the houses as aforesaid, the Sheriff for the district of Mount Ayliff, duly assisted insofar as may be necessary by members of the South African Police Services, is hereby directed and authorized to evict the respondents together with their property, families or any other persons claiming occupation through the respondents and restore such houses to the control of the applicant.”

According to the Mayor, Cllr Sobane Mnukwa, “Umzimvubu Local Municipality is committed to taking all necessary steps to evict illegal RDP occupants in the area so that the homes may be handed over to the approved beneficiaries, many of whom are elderly individuals who have been on the waiting list for a very long time. In the same tone, I vehemently condemn those who rent out RDP houses and advise those who seek rental accommodation not to occupy RDP houses from anyone.”

The municipality will commence with the eviction of more than 60 families today, 19th July 2019.
